IPOH: The motorcycle used by the 17-year-old student killed near a school here in the case involving a senior police officer is owned by a friend while the machine’s exhaust belongs to another friend, a young witness told the High Court.
“The motorcycle belongs to Zaharif’s friend. The exhaust belongs to someone else,” the witness said when cross-examined by defence lawyer M. Athimulan on the ninth day of the trial yesterday.
He was testifying in the murder trial of Deputy Supt Mohd Nazri Abdul Razak, 45, who is accused of ramming his car into Mohammad Zaharif Affendi Muhd Zamrie’s motorcycle, leading to the teenager’s death, at the intersection of Jalan Taman Jati/Jalan Pekeliling Meru Indah, near SMK Jati, between 12.05pm and 12.40pm on Dec 15 last year.
The case is being heard before Justice Datuk Bhupindar Singh Gurcharan Singh Preet.
The defence team also consists of former Perak police chief Datuk Mior Faridalathrash Wahid, and Aiman Hakim Kamaruzzaman.
Deputy public prosecutor Afzainizam Abdul Aziz led the prosecution team comprising Nasrul Hadi Abdul Ghani, V. Suloshani and Low Qin Hui.
Athimulan was questioning the witness about the ownership of the motorcycle used by the victim and its exhaust during the incident.
The witness recounted how Mohammad Zaharif informed him earlier that he had borrowed the exhaust from a friend.
“In the morning, near the grocery shop around the street, Zaharif had told me that,” said the 15th witness of the prosecution.
He also related that after the incident, he and another friend lifted up the motorcycle, which Mohammad Zaharif had borrowed from another friend.
“I have given the motorcycle key to the police and the exhaust back to the owner,” he added.
Meanwhile, the 14th prosecution witness said that when he arrived at the scene, he overheard people saying that Mohammad Zaharif had died
“I heard people saying Zaharif was no more. I was close to him as we used to hang out and ride motorcycles together,” he said.
He also testified that both the motorcycle and the exhaust had belonged to the victim’s friends.
“The motorcycle belonged to a mutual friend and the exhaust wasn’t the original one for that bike.
“The friend who lent it to Zaharif had once offered to sell it to me,” he said, adding that he could identify the four-stroke exhaust.
The trial continues on Dec 2.
