Indonesian get 15 years jail, 10 strokes for raping 11-year-old girl

KOTA KINABALU: A 50-year-old Indonesian labourer will spend the next 15 years behind bars for raping an 11-year-old girl who called him “uncle”.

Alias Ali pleaded guilty to the offence before Sandakan Sessions Court Judge Zaini Fishir @ Fisal, who sentenced him to 15 years in prison and ordered 10 strokes of the rotan.

Charged under Section 376(2)(e) of the Penal Code, which carries a prison sentence of 10 to 30 years and caning, Alias will also be deported to his home country upon completing his sentence.

He was, however, allowed to run his jail sentence from the date of his arrest.

Deputy Public Prosecutor Muhammad Al Hakim Abdul Razak informed the court that Alias, a worker at a plantation in Sandakan, committed the crime on October 29 between 11am and noon at his residence.

The victim, the granddaughter of a plantation worker, confided in her teacher about the assault, revealing what “Uncle Alias” had done to her.

The teacher promptly notified a female worker, leading to an internal investigation. Alias admitted to the crime after being questioned.

A police report was filed, and Alias was arrested at his home on Nov 3 at 12.25am.

Medical report also revealed a tear in the victim’s hymen, indicating sexual abuse.
