KUALA LUMPUR: An MP questioned the check and balance mechanism within the Malaysia Competition Commission (MyCC).
Datuk Seri Jalaluddin Alias (BN-Jelebu) said MyCC played an important role, whereby it was expected to regulate market competition, prevent the formation of cartels, and safeguard the interests of consumers, businesses, and the economy.
Such a role is stipulated under the Competition Commission Act 2010.
“There are views that perceive MyCC as a draconian commission, lacking any check-and-balance mechanisms, since all investigations, decisions, and appeals or representations are handled solely by MyCC itself.
“Who monitors and acts as a check-and-balance mechanism for its investigations and decisions? Is the ministry consulted before any decisions are made?,” he said when debating the Supply Bill 2025 at the committee stage at Dewan Rakyat here, on Wednesday (Nov 20).
Jalaluddin highlighted that MyCC was also seen to frequently issue media statements regarding proposed decisions.
However, he said the proposals are not yet considered offences.
"The Malaysian Anti-Corruption Commission (MACC) when compared to MyCC has a clearer check and balance mechanism.
“The MACC has established the Anti-Corruption Advisory Board, the Special Committee on Corruption and the Complaints Committee, all of which are formed through statutory provisions,” he added.
