Father-daughter charged for separate ‘khalwat’ offences in Terengganu Syariah Court


KUALA TERENGGANU: A father-daughter duo were charged in the Syariah High Court here for the offence of close proximity with their respective partners.

They were charged in separate courts for preparation to have an extramarital affair and ‘khalwat’ with their partners during different incidents this year.

In the father’s charge, Mat Husin Sulaiman, 53, a masseuse and Aslina Razali, 37, a cook, pleaded guilty to the charges of preparing to have an extramarital affair.

Syariah Court Judge Mohd Nazri Yusof fined each of them RM4,500 or a year in prison if they failed to pay the fine.

Based on the charge sheet, they were detained in a compromising situation at a house in Kampung Surau Haji Daud, here at about 5.20pm on May 19.

Both of them were charged under Section 29 of the Syariah Criminal Offences (Takzir) Enactment (Terengganu) Amendment 2022, which prohibits preparation for having an extramarital affair.

The charge carries a fine of not more than RM5,000 or imprisonment of no more than three years or no more than six strokes of the cane or any combination of those punishments.

In mitigation, both Mat Husin and Aslina who were unrepresented, pleaded with the court for a lenient punishment.

Both who are married to their respective partners requested that the sentence be reduced due to financial factors and their having dependents.

The case was prosecuted by the Terengganu Syariah Prosecution Department prosecutor Nurul Taqwa Hasbu who requested that they be given a severe sentence as a lesson.

Meanwhile, in a separate court, Mat Husin's daughter, Nurul Hadhari Mat Husin, 20, and Che Mohammad Aidil Hakim Rozali, 20, were charged with the offence of khalwat.

Nurul Hadhari and Aidil pleaded guilty to the charge and were fined RM3,000 and RM4,000 respectively by Judge Hamidi Syafie.

According to the charges, they were accused of performing khalwat in an apartment here at around 4.15am on March 18 this year but were only married in July.

The students at a private higher education institution got married in July and will escape the whipping penalty for repeatedly cohabiting.

The couple was charged under Section 31 (b) of the Syariah Criminal Offenses (Takzir) (Terengganu) (Amendment) Enactment 2022

Syariah Court deputy chief prosecutor Nik Mohd Shahril Irwan Mat Yusof prosecuted the case while Nurul Hadhari and Aidil were not represented.
