KOTA KINABALU: A teenager has claimed trial for allegedly raping and sodomising a six-year-old girl in Sandakan last month.
Mohammad Noor Hafiz Salleh, 18, was accused of committing the offences between 5pm and 6pm behind an abandoned building near a residential area on Nov 22.
He had allegedly grabbed her from outside her house area where she was playing and committed the offences at the abandoned building.
It is learnt that she tried to fight him off but was punched in the face and strangled.
The girl was left at the scene of the crime after the ordeal. She managed to walk home in pain, allegedly with blood running down her legs.
She got help from passersby who saw her and informed her parents, before she was brought to the hospital for examination and a police report was lodged.
When Mohammad was brought to the Sandakan Sessions Court to face charges on Monday (Dec 9), he pleaded not guilty to both rape and sodomy, which were framed under Sections 377c and 376(2) of the Penal Code.
Sessions Court Judge Zaini Fishir @ Fisal set Jan 3 for case mention, while deputy public prosecutor Muhammad Al-Hakim Abdul Razak applied for the court not to grant the bail to the accused, pending the next hearing.
The court agreed to the application.
Before this, Mohammad had also been charged with causing hurt to the same victim at the same time and location under Section 323 of the same law, to which he pleaded guilty.
The court sentenced him to a four-month jail term with a RM2,000 fine, failing which he has to serve an additional three-month imprisonment.
