Cop killing teen: Murder investigation didn't involve reckless driving angle, court hears


IPOH: A police officer told the High Court here that the element of reckless or dangerous driving was not investigated in the murder case involving the 17-year-old Muhammad Zaharif Affendi Muhd Zamrie.

Police traffic investigating officer Insp Jong Pit Chao, 37, said the investigation into the element under Section 41(1) of the Road Transport Act was not carried out as the investigation paper was taken over by another investigating officer (IO) Asst Supt Chua Sze Chuan.

The 29th prosecution witness explained that her investigation into the case only lasted for 23 hours.

"My investigation on that day, as everyone is aware, only lasted 23 hours on the first day.

"My role when I arrived at the scene of the incident was important, I had to secure the physical evidence at the scene of the incident. That was an important aspect besides the oral testimonies of the public witnesses at the scene," she said when re-examined by Deputy Public Prosecutor Afzainizam Abdul Aziz on Wednesday (Dec 11).

"I haven't had time to conduct further investigation of both elements (reckless or dangerous driving), as the case was transferred," she said.

She added that two video recordings of the victim being hit were also deleted.

"I received a call from a woman who was also a witness (13th witness) who had a dashcam in her four-wheel drive. She sent me two video recordings through WhatsApp.

"I was also instructed to no longer be an IO, so I explained it to the witness and informed ASP Chuah who took over and asked him to contact her. I also informed the witness to contact ASP Chuah. I also forwarded ASP Chuah the two video recordings.

"I deleted the videos after informing them as there was no need for me to keep the recording," she said.

The case is being testified before Justice Datuk Bhupindar Singh Gurcharan Singh Preet on Wednesday (Dec 11).

Deputy Supt Mohd Nazri Abdul Razak is charged with murdering Zaharif at the intersection of Jalan Taman Jati/Jalan Pekeliling Meru Indah, near SMK Jati, between 12.05pm and 12.40pm on Dec 15 last year.

The prosecution team was led by Deputy Public Prosecutor Afzainizam, Nasrul Hadi Abdul Ghani, V. Suloshani and Low Qin Hui.

The defense team is led by defense lawyer M. Athimulan, Mior Faridalathrash and Aiman Hakim Kamaruzzaman.

The trial continues next year (Jan 6).
