Man charged with assaulting four-year-old


JOHOR BARU: A store assistant pleaded not guilty at the Sessions Court here to two charges of sexually assaulting a four-year-old boy.

Muaz Saifullah, 23, entered his plea after the charges were read out to him before Sessions Court judge Siti Noraida Sulaiman yesterday.

According to the charge sheet, the accused had kissed the boy on his lips and performed oral sex on him at a house in Jalan Sri Stulang, Taman Sri Stulang, here between 7.30am and 6.30pm on Oct 30.

The offence under Section 14(a) of the Sexual Offences Against Children Act 2017 carries a maximum 20 year jail term and whipping upon conviction.

DPP Nur Farah Wahida Shahudin proposed bail to be set at RM20,000 for both charges with one surety, along with additional terms which included barring the accused from disturbing witnesses and the victim.

Defence counsel Mohammad Muzammil Mohammad Hairiri requested for a lower bail, saying the accused only earned between RM1,500 and RM2,000 a month.

“The accused lives with his parents and has agreed to move out to Kota Tinggi,” he said.

The court set bail at RM15,000 for the two charges with one surety and set a restraining order for the accused not to be within six kilometre of the victim.

Next mention was set for Jan 28.
