PETALING JAYA: The High Court has rejected the application of Syed Saddiq Syed Abdul Rahman (pic) and three others for leave to challenge the government's decision to withdraw an allocation of RM730,300 for his constituency.
Judge Wan Ahmad Farid Wan Salleh, who is now a Court of Appeal judge, said the application by the Muar MP, with Najib Abu Nawar, Mohd Bakirudin Abdullah and Muhamad Fadzly Bisri was made after the allowed period had expired.
He said matters of allocation are an executive matter which falls outside the court's purview and that the courts are bound with the earlier decision and can't be decided through a judicial review, reported Sinar Harian.
On April 23, Syed Saddiq with three others who were Muar voters filed an application through lawyers Lim Wei Jiet naming the Prime Minister and the government as respondents.
The applicants sought a certiorari order to quash a decision by the respondents that halted the balance of RM500,000 from RM1.7mil in total that was supposed to be channelled directly to the Muar public service centre.
The funds were meant to cover the expenses of welfare programmes for the Muar constituents.
The applicants are also seeking Syed Saddiq's reinstatement of his access to the myKHAS system, which he claims the respondents revoked.
In the supporting affidavit, affirmed by Syed Saddiq, the parliamentarian said that on Sept 10, last year, Muda had decided to pull its support from the unity government led by the first respondent.
Shortly after the announcement, Syed Saddiq claimed that the RM500,000 balance in his allocation was stopped or revoked.
The application was filed on the reason that the respondents have gone against the equal allocation, which is enshrined in Article 8 of the Federal Constitution.
