MELAKA: A prominent businessman and former soldier with the title "Datuk Seri," his daughter, son-in-law and two employees claimed trial at the Magistrate's Court in Ayer Keroh here to charges of allegedly causing injury to a 30-year-old man.
The accused, Mohamad Fazil Shafie, 62; Nur Amalina Mohamad Fazil, 32; Amran Azmi, both 32-year-old and two company employees, Azian Ab Rahim, 37, and Muhammad Azrul Syafiq Rosman, 28, entered their plea before Magistrate Nor Syaliati Mohd Sobri after the charges were read to them by the court interpreter on Mon (Dec 30).
According to the charges, they were accused of intentionally causing injury to Muhammad Nur Hakim Baharudin.
The charges were framed under Section 323 of the Penal Code, read together with Section 34 of the same code.
They could face imprisonment of up to one year, a maximum fine of RM2,000, or both, upon conviction.
The accused were also charged with intimidating the same victim.
In the same proceedings, Azian faced a similar charge against the same victim.
If convicted, she could face up to two years imprisonment, a fine, or both under Section 506 of the Penal Code.
Nur Amalina was also charged with using offensive and insulting words against the victim.
The accused could face a fine not exceeding RM100 under Section 14 of the Minor Offences Act 1955, upon conviction.
The alleged offences were committed at an eatery in Taman Kota Laksamana, Melaka Tengah, at about 8.30pm on Nov 14.
Earlier, the prosecution, led by Deputy Public Prosecutors Nor Azizah Yusof and Hanis Aliah Ahmad Kamarulnajuib, offered bail of RM5,000 for each of the accused.
However, lawyer Bala Subramaniam, representing the five, requested a lower bail of RM1,000, citing the negative impact the case had on his clients' business.
He also requested the court to issue a "gag order" on the case.
Nor Azizah Yusof, in her rebuttal, objected to the defence's request, arguing that this was a standard case and such an order was unnecessary.
The court subsequently rejected the defence's application for a "gag order" and set bail at RM5,500 for Mohamad Fazil and Azian for all charges.
Nur Amalina was granted bail of RM3,300, while Amran and Muhammad Azrul Syafiq were granted RM2,500 each.
The re-mention of the case was fixed on Jan 23, next year.
