MELAKA: A prominent businessman, his daughter, son-in-law and two employees have claimed trial at the Magistrate’s Court in Ayer Keroh here to charges of causing hurt and threatening an insurance manager.
Datuk Seri Mohamad Fazil Shafie, 62, Nur Amalina Mohamad Fazil and Amran Azmi, both 32, and two company employees Azian Ab Rahim, 37, and Muhammad Azrul Syafiq Rosman, 28, entered their plea before Magistrate Nor Syaliati Mohd Sobri.
According to the charges, they had intentionally caused injury to Muhammad Nur Hakim Baharudin, 30.
Under Section 323 of the Penal Code, they could face imprisonment of up to one year, a maximum fine of RM2,000, or both, upon conviction.
The accused were also charged with intimidating the same victim with words such as “Jangan buat lagi kerja bukan-bukan..., kalau tak..., hang tak tau.., kerja komando macam mana” (“Don’t do any nonsense again... or else... you don’t know... what commando work is like”).
In the same proceedings, Azian faced a similar charge against the same victim, with the alleged words, “Jangan sampai suami aku cari korang kat luar” (“Don’t make my husband come looking for you outside”).
If convicted under Section 506 of the Penal Code, she could face up to two years imprisonment, a fine, or both.
Nur Amalina was also charged with using offensive and insulting words against the victim. She could face a fine not exceeding RM100 under Section 14 of the Minor Offences Act 1955, upon conviction.
Earlier, the prosecution, led by deputy public prosecutors Nor Azizah Yusof and Hanis Aliah Ahmad Kamarulnajuib, offered bail of RM5,000 for each accused.
However, lawyer Bala Subramaniam, representing the five, requested a lower bail of RM1,000, citing the negative impact the case had had on his clients’ business.
He also requested the court issue a gag order on the case.
Nor Azizah objected to the defence’s request, arguing that this was a standard case and such an order was unnecessary.
The court subsequently rejected the application for a gag order and set bail at RM5,500 for Mohamad Fazil and Azian for all charges.
For Nur Amalina, the court set bail at RM3,300, and RM2,500 each for Amran and Muhammad Azrul.
The court fixed Jan 23 for mention.
