Senior police officer’s trial: Collision scenarios revealed in Miros report


IPOH: There are two situations that could have caused the collision between the car driven by a senior police officer, and the motorcycle the student was on, a High Court here heard.

The Malaysian Institute of Road Safety Research (Miros) accident analysis and unit head Ahmad Noor Syukri Zainal Abidin said this when testifying in a trial of the senior police officer charged with the murder of a secondary school student in 2023.

Ahmad Noor Syukri said the first possibility is that the car continued to travel at a consistent speed, while the motorcycle slowed down as it approached the point of impact.

“The second probability is that the motorcycle travels at a consistent speed while the car accelerates as it approaches the point of impact.

“However, in the absence of additional information from the car’s Event Data Recorder (EDR) system, the probability of which situation is more likely cannot be determined,” he said in his written statement before Justice Datuk Bhupindar Singh Gurcharan Singh Preet on Monday (Jan 6).

Later when Deputy Public Prosecutor Afzainizam Abdul Aziz showed the witness the EDR report that was prepared after his (Ahmad Noor Syukri) report, Ahmad Noor Syukri agreed that situation number one was more applicable.

Ahmad Syukri said that based on the data collection and analysis conducted by the team from Miros, the first rear-end collision occurred when the car was tailgating the motorcycle too closely without a safe distance. He said the impact of the first collision occurred when the right front of the car hit the rear of the motorcycle, causing the motorcycle to fall to the left.

“The motorcycle was underridden to the lower right front of the car and then dragged to the right side of the road.

“The average speed at a distance of approximately 50m before the point of impact for the car was 89.76km/h while for the motorcycle was 94.92km/h,” he said.

Counsel M Athimulan had objected to the Miros report under Section 399 of the Criminal Procedure Code stating that the evidence of the witness was an expert-based one, and not on a factual basis.

However, DPP Afzainizam said that the report was tendered under Section 45 of the Evidence Act.

Justice Datuk Bhupindar Singh allowed for the report to be marked as an exhibit.

“This can be added during submissions at the end of the prosecution case,” he said.

Deputy Supt Mohd Nazri Abdul Razak is charged with murdering 17-year-old Mohammad Zaharif Affendi Muhd Zamrie at the intersection of Jalan Taman Jati/Jalan Pekeliling Meru Indah, near SMK Jati, between 12.05pm and 12.40pm on Dec 15, 2023.

The defence team also consists of former Perak police chief Datuk Mior Faridalathrash Wahid and Aiman Hakim Kamaruzzaman.
