Doc claims trial to raping clinic assistant


KUALA LUMPUR: A 35-year-old medical doctor has claimed trial at the Sessions Court here to two charges of raping his clinic assistant and committing carnal intercourse against the order of nature.

The accused allegedly raped the 21-year-old victim in the storeroom of a clinic at Pantai Dalam between 4am and 5am on Saturday (March 15).

The offence was framed under Section 375(b) of the Penal Code, punishable under Section 376(1) which provides for a maximum 20-year imprisonment and whipping, if convicted.

He was also accused of committing carnal intercourse against the order of nature on the victim at the same place and time.

The charge under Section 377C of the same legislation provides for imprisonment between five and 20 years with caning if convicted.

The accused pleaded not guilty after the charges were read out here on Friday (March 21).

DPP Nidzuwan Abd Latip did not offer bail on the grounds that it was a non-bailable offence.

However, lawyer Adi Zulkarnain Zulkafli, who represented the accused, pleaded for bail to be allowed.

He said his client was a practising doctor at a clinic who was supporting his wife and three children.

"The defence does not object if additional conditions are imposed on the accused," Adi said.

Sessions judge Mohd Zaki Mohd Salleh allowed bail at RM18,000 in one surety.

He also imposed additional conditions whereby the accused must surrender his passport to the court and report to the nearest police station twice a month.

The court also ordered the accused to stay away from the prosecution witnesses.

The case is fixed for mention on April 23.
