A food delivery driver mistakenly dropped a late-night delivery at the wrong home, Missouri police said. When he went back to retrieve the order, he was shot, according to court records.

Dwayne Jones approached the delivery driver in his driveway and shot him in the stomach after the driver went to get the food sitting outside the home shortly after midnight July 7, St. Charles County police said.

When officers arrived at the O’Fallon residence, they found the driver lying in the driveway with a witness performing life-saving measures, police said. The man was rushed to a hospital with life-threatening injuries and taken for surgery, according to the probable cause statement.

Attorney information for Jones was not listed.

Police said the delivery driver posed no threat to Jones.

Jones was arrested and charged with assault and armed criminal action, according to court records. He was not given bond.

During the arrest, police said Jones “made several statements acknowledging that he shot the victim.” However, he refused to answer questions during a formal interview without an attorney present.

Jones is scheduled to appear in court on July 17.
