Court strikes out RM303.5mil suit against MRT Corp, MMC Gamuda

KUALA LUMPUR: The High Court has struck out Accolade Land Sdn Bhd’s RM303.53mil suit against Mass Rapid Transit Corp Sdn Bhd (MRT Corp) and the Klang Valley MRT project’s delivery partner, MMC Gamuda KVMRT (PDP) Sdn Bhd.

In a filing with Bursa Malaysia, MMC Corp Bhd said the court had on Thursday allowed applications filed by its jointly-controlled entity MMC Gamuda and the other defendants and ordered that the suit be struck with costs.

The suit, filed in June last year, was premised on an alleged breach of an alleged contract between Accolade and MRT Corp relating to the purchase of Accolade’s land by MRT Corp for the Klang Valley MRT project.

Accolade claimed, jointly and severally against the defendants, RM303.53mil in damages with interest and costs.

According to MMC’s announcement on Friday, the High Court found that Accolade’s suit was totally unsustainable on, among others, these premises: the alleged oral agreement was not supported by any existing evidence and, even if there was indeed a contract, Accolade had no cause of action as there was no possible inducement for breach of contract.
  
MMC said the court’s decision was not expected to have any major financial and operational impact on the MMC group for the financial year ending Dec 31, 2017.
